The National Government faces backlash for threats against Judge Karina Andrade who ordered the release of detainees protesting against repression. Human rights organizations demand respect for constitutional rights.

Judges Under Threat: Support for Judicial Independence

The National Government, the City Council of the Judiciary, the legal community, and society in general should support, and not punish, judges who comply with the basic rules of the Rule of Law. Various human rights and judicial organizations have expressed their support for a recent ruling, emphasizing that it is essential for "the government to respect those who apply the Constitution."

Judge Karina Andrade issued a ruling releasing 114 people detained during a violent crackdown on protesters, including retirees, fans, journalists, and citizens in general. In her decision, the magistrate took into account the fundamental constitutional right to protest and freedom of expression, arguing that the Judiciary must protect these democratic rights.

Various human rights organizations, such as Madres de Plaza de Mayo LĂnea Fundadora, condemned the threats and attacks from national government officials against Judge Andrade. They also denounced the mass and indiscriminate arrests as a serious abuse in a context where the police stations of the City of Buenos Aires are overwhelmed with detainees in precarious conditions.

Judge Andrade's ruling was supported by institutions such as the Institute of Comparative Studies in Criminal and Social Sciences, the Latin American Institute of Security and Democracy, and the Association of Lawyers of Buenos Aires, among others. These groups stressed the importance of respecting constitutional norms and curbing abuses of power, both public and private.

On the other hand, the National Minister of Justice threatened to take action against Judge Andrade for her decision to release the detainees, which sparked criticism and questioning about the independence of the Judiciary. In a context of tensions between the Executive and the Judiciary, it is crucial to guarantee the separation of powers and respect for the Constitution.

In summary, Judge Andrade's case highlights the importance of protecting the Rule of Law, respecting fundamental rights, and judicial independence. Judicial decisions must be based on legality and the defense of democratic principles, avoiding any attempts of coercion or pressure from other branches of the State.
